Consent to the Collection and Processing of Personal Data
In accordance with the Law of the Republic of Kazakhstan dated May 21, 2013 No. 94-V "On Personal Data and Their Protection" and other regulatory legal acts of the Republic of Kazakhstan (hereinafter collectively referred to as the Law), I hereby give my unconditional consent in electronic form to the Limited Liability Partnership "TZEM Solutions" BIN 250440010275 (hereinafter referred to as the Operator) and Third Parties, i.e., persons related, both currently and in the future, to the Operator by circumstances or legal relations for the collection, processing, and protection of my personal data, for the collection, processing, storage, and cross-border transfer in ways that do not contradict the Law, for purposes regulated by this consent, in connection with arising relations with the Operator or any existing or future civil law and/or other legal relations regarding my personal data recorded on electronic, paper, and/or other material carriers, including but not limited to:
1) Document data confirming identity: type of identity document, number, series (if available); surname, first name, patronymic (if available); date and place of birth; citizenship (if available); individual identification number (if available);
2) For foreign citizens: number, date of issue, validity period of visa (if a foreign passport is presented as an identity document) (except for citizens of countries entering the Republic of Kazakhstan without a visa); number, date of issue, validity period of migration card (if a foreign passport is presented as an identity document) (for citizens of countries entering the Republic of Kazakhstan without a visa); affiliation to foreign public officials or related persons (family members);
3) Address of residence (registration) or place of stay (country/jurisdiction, postal code, locality, street/area, house number and apartment number if available);
4) Contact phone number;
5) Photo and video images;
6) Card data (card number), IBAN;
7) Email address (if available);
8) Other data upon request from the Operator and my voluntary provision.
The collection, processing, storage, and cross-border transfer of personal data by the Operator is carried out for the following purposes including but not limited to:
1) Providing the Client access to payment services in accordance with the Rules and legislation of the Republic of Kazakhstan in the field of payments and payment systems; legislation of the Republic of Kazakhstan in combating money laundering; financing terrorism; and financing the proliferation of weapons of mass destruction;
2) For proper fulfillment by the Operator of rights and obligations imposed on it by legislation;
3) For internal control and accounting by the Operator;
4) For judicial and extrajudicial protection of rights: in case of violation by Subjects; in case of disputes including disputes with Third Parties.
I confirm that:
1) This consent applies to all relations with the Operator including existing or arising upon granting this consent as well as any others that may arise in the future. It is valid both during my relations with the Operator and after their termination for periods established by legislation necessary for proper fulfillment by the Operator of rights and obligations imposed on it by legislation;
2) By this consent I grant the Operator the right to independently determine conditions for Third Parties' access to personal data;
3) No notification is required from me when collecting processing or cross-border transferring personal data by the Operator;
4) This consent may be provided to Third Parties as evidence that the Operator has necessary authority for collecting processing and cross-border transferring personal data;
5) This consent may be revoked in cases regulated by legislation based on a corresponding application submitted in writing at least 30 calendar days before revocation. I understand that according to Law this consent cannot be revoked if such revocation contradicts Law or if I have unfulfilled obligations towards the Operator or Third Parties. In particular due to legislative requirements revocation applies to collection processing storage and transfer from such revocation moment without affecting data collected processed or stored by Operator before such revocation for 5 years after complete termination of my relations with Operator. I understand that revoking consent for collection processing storage and transfer may mean inability to receive goods works services provided by Operator. I acknowledge that in case such revocation occurs Operator is released from any liability towards me for non-provision/incomplete/timely provision/provisioning goods works services from such moment;
6) I will have no claims against Operator regarding collection processing or cross-border transfer of my personal data provided that requirements set forth by Law are met;
7) Receiving services from Operator upon being informed about necessity to provide such Consent means my full acceptance without reservation conditions set forth in this Consent;
8) Consent expressed electronically is equivalent to consent provided on paper;
9) In case I disagree with conditions set forth in this consent statement regarding collection processing storage transfer including cross-border transfer my refusal from using services provided by Operator obtaining goods works services from it is solely my responsibility.
I have fully read this consent text have no additions comments or objections. Consent is expressed through conclusive actions according to Client Agreement (Agreement on Use of Electronic Money System).
